WRC recommends €480 payment to driver over sick pay process

By Niamh Kearney

Workplace Relations Commission ·

The WRC recommended that a transport company pay a driver €480 after finding it had not followed fair procedures when refusing his occupational sick pay claim. The decision was dated 17 May 2017. The driver sought the shortfall after taking sick leave following a work-related collision. He said he was not interviewed before the first refusal and was not told about the CCTV assessment or given a chance to answer its findings. The company defended its process, saying each claim required careful investigation. The adjudication officer recommended payment within 42 days and suggested the company consider reviewing the scheme’s requirements and procedures.
