WRC orders two separate €1,000 payments over worker’s complaints

By Cathal Brosnan

Workplace Relations Commission ·

The Workplace Relations Commission ordered an employer to pay a worker €1,000 for failing to provide written employment terms and a separate €1,000 net over sick pay. In a decision dated 30 April 2018, the WRC also found her complaint about changes to her terms not well founded and recommended mediation on two industrial-relations disputes. The worker, a legal executive and office manager, said she had not received written terms and that sick pay was withdrawn when she became unfit to work. The employer said it had provided written terms in February 2017 and had no automatic obligation to pay during an extended illness absence. The WRC found an implied entitlement to short-term sick pay of 10 days a year, subject to normal protocols. The two industrial-relations disputes concerned alleged unreasonable treatment and other employment matters; the officer recommended mediation when the worker returns to work.
