WRC recommends expunging sales assistant’s written warning

Workplace Relations Commission ·

The Workplace Relations Commission recommended that a retail company remove and expunge a sales assistant’s first written warning, finding the disciplinary process flawed. The recommendation was dated 12 June 2017. The dispute followed an investigation into alleged bullying and a separate allegation that the assistant had made false statements during the investigation. He argued that the comments relied on to discipline him had not been formally put to him. The company said it had a robust policy and that he received his full rights. The adjudication officer said an investigator could recommend a separate process for concerns outside the matters directly under investigation, but should not invoke discipline against a participant in the investigation. He recommended removing and expunging the warning.
