WRC rules rental discrimination complaint outside its jurisdiction

By Aoife Loughran

Workplace Relations Commission ·

The Workplace Relations Commission found that applicant a’s Equal Status complaint against a property letting agent was outside its jurisdiction and was not upheld; the merits were not decided. Adjudication officer Pat Brady dated the decision 27 July 2017.

The complaint arose after a family’s attempt to rent a property fell through. The applicant said the landlord would not accept one family member as a tenant because that person received social welfare. The Applicant Also said fear of retaliation had delayed notice of the complaint.

The letting agent argued that the applicant had missed the deadlines for notifying it and seeking an extension. The WRC found the extension request came nearly six months after the incident, beyond the four-month period available under the Act. It ruled that it could not consider the complaint. The decision was one of several related cases brought by members of the same family over the proposed tenancy.
