The WRC found that a general operative was not unfairly dismissed, ruling that he left his job voluntarily before his fixed-term contract ended. The decision was dated 18 August 2017. The worker said he expected a new assignment after a job in Cavan ended. The civil engineering company said it offered him work in Dublin through the contract’s end, which he declined. The adjudicator accepted the company’s account and found that the worker had left voluntarily. The copy of the written contract was unsigned, so the statutory exclusion for dismissal on expiry of a fixed-term contract did not apply; the officer nevertheless found that no dismissal had occurred.
