The Workplace Relations Commission awarded a banqueting worker €2,500 after finding that a hotel’s failure to offer her work amounted to constructive unfair dismissal. Adjudication Officer Kevin Baneham dated the decision 26 April 2018. The worker said she received very few shifts after returning from maternity leave and resigned after repeatedly seeking hours. The hotel said shifts were available, that she had missed some rostered work and that she had not completed its written grievance process. The WRC found there was no evidence the worker had been told about a change to how shifts were allocated, and resolved conflicting evidence in her favour. It found she had substantially used the grievance process and that the failure to offer hours repudiated her employment contract. The €2,500 award reflected her alternative part-time work and the possibility she could have continued working hotel functions alongside it.
