The WRC recommended removing a delivery driver’s final written warning and replacing it with a three-month verbal warning. The recommendation was dated 11 May 2017. The driver admitted using his personal phone while driving, apologised and said he would not do it again. The department store said this breached its policy. The adjudicator found the company’s policies did not clearly link phone use to serious misconduct and a final written warning, and considered the sanction disproportionate. She also recommended that the parties align their workplace policies on mobile phone use.
