The WRC deferred a kitchen porter’s Payment of Wages claim because related legal proceedings were before a superior court, in a decision dated 14 June 2017. The merits of that claim were not decided. The officer found no breach of the porter’s contract terms, while making no finding on his industrial relations dispute until he had exhausted the grievance procedure. The porter had also complained about an unaddressed grievance and a change to his contract without agreement. The service company said it had observed the contract terms and that he had not completed the grievance process.
