WRC finds quality-control assistant’s discrimination complaint was out of time

By Rory Hanlon

Workplace Relations Commission ·

The WRC found that a grocery retailer’s quality-control assistant had a disability for the purpose of her complaint, but ruled that the complaint was out of time and not well founded; the merits were not decided. The decision was dated 20 March 2018.

The worker said the retailer failed to accommodate her by moving her to a different manager. The adjudicator treated 17 February 2016 as the last date on which discrimination could have occurred, and found the complaint was filed outside the six-month limit. She declined to extend the deadline, finding no reasonable cause for the delay, and rejected the claim that the alleged discrimination was ongoing.
