The Workplace Relations Commission found that Applicant C’s Equal Status complaint against a property letting company was outside its jurisdiction and was not upheld; the merits were not decided. Adjudication officer Pat Brady dated the decision 27 July 2017.
The complaint followed a family’s attempt to rent a property. The family said the landlord would not accept one member as a tenant because that person received social welfare, and the prospective tenancy fell through. Applicant C alleged discrimination and said fear of retaliation explained the delay in notifying the company.
The company argued that the written notice and request for an extension missed the statutory deadlines. The WRC found the extension was not sought until nearly six months after the incident, beyond the four-month period available under the Act. It therefore ruled that it could not consider the complaint.
