The Workplace Relations Commission awarded a worker €2,500 after finding his dismissal unfair because his employer failed to follow fair procedures. The decision was dated 5 May 2017. The employer argued that the complaint was out of time, but the adjudication officer found it had been lodged within six months after taking the statutory notice period into account. The officer criticised the worker’s delays in returning to work and said his conduct made a substantial contribution to the situation. The dismissal was nevertheless unfair because the employer did not put him on notice of a hearing or follow fair procedures.
