The Workplace Relations Commission upheld a security guard’s unfair dismissal complaint and ordered the security company owner to pay him €9,000. The decision was dated 15 May 2017. The owner said the guard had admitted sleeping during patrols and filing false reports. The guard disputed those claims. The adjudication officer found the performance problems did not justify dismissal and that the owner failed to follow the disciplinary policy, warn that the meeting could lead to dismissal, or tell the guard of his right to representation. A related Industrial Relations Act complaint was not processed because it concerned the same matters as the unfair dismissal claim.
