The WRC found a shop worker’s redundancy claim was not well founded and his minimum-notice claim was out of time. The decision, dated 16 June 2017, said the evidence did not establish a transfer of undertaking, so the respondent was not liable for redundancy. The redundancy claim failed on its merits; the merits of the time-barred minimum-notice claim were not decided. The worker said he had moved among the previous owner’s stores and was not told who employed him or how the businesses were connected. He argued that a transfer of undertaking had taken place and that he was entitled to redundancy pay. The respondent said the previous owner closed all the stores and let the staff go. It later reopened one shop and asked the worker to return while it tested whether the business was viable. The respondent said the shop closed when it was not viable.
