WRC awards employee €15,000 for constructive dismissal after accounting concerns

By Rory Hanlon

Workplace Relations Commission ·

The Workplace Relations Commission awarded an employee €15,000 after finding that his employer breached his contract following concerns he raised about company accounts. The decision was dated 26 March 2018.

The employee said he raised concerns about inaccurate accounts and unrecorded rebates. He said he was later excluded from meetings and his salary was cut. The company disputed aspects of his account.

The WRC found a link between his concerns and the company's changed attitude and decision to demote him. It found the unexplained demotion and salary cut breached his contract and upheld his constructive dismissal complaint. A separate wages complaint succeeded for deductions between 20 January and 2 June 2016, with €10,500 awarded. The €10,000 claimed as cash expenses was not wages properly payable.
