WRC dismisses retail worker’s discrimination and employment information complaints

By Ruairí Dolan

Workplace Relations Commission ·

The Workplace Relations Commission dismissed a retail worker’s discrimination and employment information complaints against a department store in a decision dated 28 September 2017. A separate unfair dismissal complaint had been withdrawn before the hearing. The worker alleged discrimination on grounds including religion and race, as well as harassment and victimisation. He said disputes over working hours, leave and the handling of a workplace accident contributed to his resignation. The store disputed the claims. The adjudication officer found insufficient evidence to support the discrimination complaint, including the allegation of constructive dismissal. The employment information complaint was also dismissed because the officer found no specific evidential basis for it.
