WRC awards production operative €9,500 for unfair dismissal

By Aoife Loughran

Workplace Relations Commission ·

The WRC awarded a production operative €9,500 after finding his dismissal unfair in a decision dated 12 June 2017. The officer found he had not received full details of the allegations or a chance to challenge the evidence, and that the dismissal decision had been made before the disciplinary hearing began. The medical devices producer said he had sprayed isopropanol at a colleague in a clean-room production area, amounting to gross misconduct and a breach of safety rules. The operative described it as misguided horseplay and argued dismissal was disproportionate. The officer found his actions contributed significantly to his dismissal and took that into account in setting compensation.
