The Workplace Relations Commission found no discrimination in human health & social work’s withdrawal of a support-worker job offer after an occupational-health report raised a concern about lone working. Adjudication Officer John Tierney dated the decision 28 September 2017.
The claimant said the respondent had refused reasonable accommodation. The respondent said it could make the other recommended adjustments but could not avoid lone working in its services. The adjudicator found that independent occupational-health evidence still identified lone working as a risk, although a low one, and that the respondent was prepared to provide other accommodations but could not economically employ someone to support the claimant in lone work. The discrimination claim was not well founded.
