The Workplace Relations Commission dismissed a warehouse operative’s unfair-dismissal claim, finding the distribution centre’s main employer was the proper respondent and had followed a full and fair process through the appeal stage. The decision was dated 20 November 2017. The operative said the process was flawed and the evidence did not establish the alleged assault. The company said dismissal followed a violent exchange and an investigation, disciplinary process and appeal. The officer found the witnesses credible and concluded that dismissal fell within the band of reasonableness for an employer in a similar situation or industry.
