The WRC dismissed a general operative’s unfair dismissal claim after finding that a genuine economic redundancy had taken place. The decision, dated 18 September 2017, also noted a possible technical breach of employment terms concerning an earlier period, while finding that a formal contract issued in January 2015 was satisfactory. The worker alleged his dismissal was linked to a personal injury claim and also raised bullying concerns. The WRC found the personal injury issue had no material bearing on the redundancy decision and said discussions about bullying and alleged harassment produced no concrete evidence or basis for a complaint. It directed the worker to the January 2015 contract and said no financial compensation was warranted.
