The WRC ordered a supermarket to pay a deli assistant €2,500 after finding it penalised her for raising health and safety concerns. The decision was dated 28 July 2017.
The assistant raised concerns about trip hazards and unhygienic conditions in the food preparation area. Managers reprimanded her and told her to stop taking photographs and complaining, which the adjudication officer found was penalisation.
Her complaints of race discrimination and discriminatory constructive dismissal were not well founded. The officer found her treatment was not linked to her Lithuanian nationality and that she resigned before an external investigation into her grievances began.
