WRC grants construction operative redundancy entitlement and €500 for missing terms

By Donal Gilhooly

Workplace Relations Commission ·

The WRC found that a construction operative was entitled to a redundancy payment and ordered his employer, a building company, to pay him €500 for failing to provide written employment terms. The decision was dated 1 May 2018. The worker said he returned to work in November 2016 but was not allowed to resume. The company said it needed fitness certification and manual-handling training before his return, and that a cancelled job delayed it. The worker later began a new job. The WRC found that the worker was on temporary lay-off and had not been dismissed, so his unfair-dismissal complaint was not well founded. The redundancy complaint was upheld, with the entitlement based on his employment and pay details. The company was also required to pay €500 for the breach of the Terms of Employment (Information) Act.
