The Workplace Relations Commission found that a security worker was unfairly dismissed by a night club and ordered it to pay €3,000. The decision was dated 6 July 2017. The night club said the worker used excessive force against a customer during an incident on 13–14 August 2016. He denied touching her. The adjudication officer found that the employer had not given him the customer’s solicitor’s complaint letter, had not adequately weighed witness accounts and had delayed its decision. The officer also criticised the employer’s reasons for not suspending him during the investigation. The officer found the dismissal unfair, but said the worker contributed to it and reduced the award by 20%. The officer ordered the employer to pay €3,000 compensation.
