The WRC found a general operative’s race discrimination complaint against a retail company was not well founded and ruled it had no jurisdiction over his equal-pay claim. The decision was dated 31 August 2017. The worker said four direct hires earned €10.20 an hour while he earned €10.04, and that he had not had a fair chance to apply for permanent work. The company said he was considered for a permanent role, passed a medical and was placed on a candidate panel. The WRC found he applied and was placed on the panel, but left before he could be appointed. It found he had not established facts supporting race discrimination. His claims about written terms, wages, working time and age discrimination were withdrawn. The merits of the equal-pay claim were not decided because the WRC found it had no jurisdiction.
