WRC awards ground worker €1,600 after rejecting redundancy claim

By Rory Hanlon

Workplace Relations Commission ·

The WRC rejected a ground worker’s redundancy claim but awarded him €1,600 compensation for a minimum notice breach. Adjudication Officer Patsy Doyle dated the decision 24 July 2017. The worker said his employment ended when work at the site finished and sought redundancy and notice pay. The ground work company said it expected to place him on temporary layoff and later offered him a comparable ground worker role in Ringaskiddy, which he declined. The WRC found that the 22 November letter was a dismissal, but that the offer of continuing work within a reasonable commuting distance was suitable and unreasonably refused. The redundancy complaint was not well founded; the separate minimum notice complaint succeeded, and the company was ordered to pay €1,600 compensation.
