General operative’s terms complaint partly upheld against recruitment agency

By Aoife Loughran

Workplace Relations Commission ·

The WRC partly upheld a general operative’s complaint about written employment terms, finding that the recruitment agency omitted required information about the national minimum wage. The decision was dated 30 August 2017. The worker was paid €10.04 an hour, above the minimum wage, and received no compensation. The WRC found the worker’s travel-pay, annual-leave, public-holiday, Sunday-premium and temporary-agency-work complaints not well founded. It also found the race discrimination complaint not well founded and had no jurisdiction to hear the equal-pay complaint. The worker’s road-transport working-time complaint was withdrawn at the hearing.
