The WRC found a photographer’s assistant was entitled to a redundancy lump sum after her employer and brother died, and awarded €744 for lack of notice. Adjudication Officer Joe Donnelly dated the decision 15 November 2017. The worker had been continuously employed in her brother’s photography business since 4 January 1980, working one day a week from 2012. The WRC found her employment ended when he died on 23 January 2016, making her redundant under section 21 of the Redundancy Payments Act. Her lump sum entitlement was based on service from 4 January 1980 to 23 January 2016 and gross weekly pay of €195, subject to her having been in insurable employment. The WRC also found she received no notice and awarded €744 compensation for her first minimum-notice complaint. A second complaint under the same Act was dismissed as a duplicate. Her brother’s widow had no involvement in the photography business.
