The WRC upheld a procurement officer’s unfair dismissal complaint and set compensation at a maximum of four weeks’ remuneration in a decision dated 20 November 2017. It found that combining performance concerns with an alleged refusal to follow an instruction in one disciplinary decision made it impossible to know which issue led to the dismissal and undermined procedural fairness. The health and safety complaint was not upheld because there was insufficient evidence that a health and safety grievance had been raised. The two Industrial Relations Act complaints were withdrawn at the hearing.
