The Workplace Relations Commission found that a home-based technical support advisor’s complaint about his dismissal during probation was not well founded. The decision was dated 15 September 2017.
The worker said illness-related absences should not have counted towards the company’s attendance threshold and sought compensation or re-engagement. The computer company said five absences and broadband connection problems meant he had not passed probation.
The adjudicator found the company followed its attendance and probation procedures, including warning him that further absences could put his job at risk. The adjudicator also said power and broadband outages were missed opportunities for both sides to arrange another way for him to work. The complaint was under the Industrial Relations Act, and no change to the dismissal was recommended.
