WRC rejects agency worker’s minimum wage complaint over travel time

By Rory Hanlon

Workplace Relations Commission ·

The Workplace Relations Commission (WRC) found no breach of the National Minimum Wage Act in an agency worker’s complaint about unpaid travel time and a request for a pay statement. The decision was dated 30 August 2017. The worker argued that travel from the agency’s Inchicore office to his workplace in Finglas should count as working time. The agency said workers knew they would be sent to client workplaces and that the Inchicore visit was an unpaid induction. The adjudication officer found Finglas was the workplace and did not include travel time in working hours. The officer also found no general entitlement to payment for the induction day and was satisfied the agency had replied to the request for a pay statement.
