A WRC adjudication officer awarded a general operative €6,000 after finding his dismissal by a food manufacturing plant substantively and procedurally unfair. In a decision dated 2 May 2018, Eugene Hanly said dismissal was disproportionate because the worker had no prior disciplinary history for the conduct and should have had an opportunity to address it. The officer also found the worker’s conduct unacceptable and said he had contributed considerably to his dismissal; that contribution was reflected in the award. The employer said it had investigated complaints about his conduct, followed fair procedures and dismissed him for serious behaviour. The worker disputed the process and said his own complaint about a supervisor was not properly addressed.
