WRC finds residential care worker’s unfair-dismissal complaint not well founded

By Ruairí Dolan

Workplace Relations Commission ·

The WRC found a residential care worker’s unfair-dismissal complaint was not well founded, concluding that the investigation, disciplinary and appeal processes followed fair procedures. The detention centre said the worker’s handling of an incident involving a young person caused injuries and led to dismissal. The worker disputed the process and said the dismissal was disproportionate. The adjudication officer found the worker had received refresher training and had the opportunity to defend his actions. The decision was dated 17 January 2018.
