The Workplace Relations Commission awarded a driver €5,880 under the Payment of Wages Act and €4,000 compensation for race discrimination. It also found his minimum-notice and annual-leave claims well founded, granting four weeks' pay in lieu of notice calculated using a gross weekly wage of €700, and €280 for two days' leave. Adjudication Officer Penelope McGrath dated the decision 23 October 2017.
The driver said his night shifts, scheduled from 10pm to 6am, often continued while he emptied and returned his truck, leaving him unpaid for extra hours. He also said travel to some daytime jobs went unpaid. The company denied that he worked beyond his paid eight hours and said there were no obvious colleagues for comparison.
The adjudicator accepted the driver's account, supported by a recycling-facility log showing him still working about an hour after his scheduled shift ended. She found he was treated less favourably than colleagues who were paid for certain hours for which he was not paid, and that the company had not rebutted the race-discrimination finding.
