WRC rejects chef’s redundancy payment claim

By Aoife Loughran

Workplace Relations Commission ·

The WRC rejected a chef’s redundancy payment claim against a restaurant owner, finding no genuine redundancy existed. The decision was dated 29 August 2017. The chef said the owner told him there were no hours for him and offered €500 after he calculated a statutory figure of €3,200. The owner said the job remained available if the chef could return to work and denied a redundancy situation. The adjudication officer noted conflicting evidence and found the chef’s account contradictory about whether there were no hours despite staff being needed. The application was refused.
