The Workplace Relations Commission found that a sales consultant was not an employee of an e-commerce company and had no jurisdiction to consider his unfair-dismissal complaint. The decision was dated 15 December 2017; the merits were not decided. The consultant said he provided substantial work in his own time, was controlled and integrated into the company and received share options and €250 in expenses. The company said he was a consultant who received no salary or equipment and was expected to work five hours a week while holding another full-time job. The adjudication officer found that the consultant provided a limited service, controlled how it was delivered and was not integrated into the business. The officer concluded he was working under a contract for services, not as an employee.
