WRC backs pro-rata share allocation in data analyst’s ESOP dispute

By Ruairí Dolan

Workplace Relations Commission ·

The Workplace Relations Commission recommended that a commercial state body accept the existing pro-rata share allocation system after a data operations analyst disputed the number of shares she received. The recommendation was dated 29 November 2017. The analyst sought €4,458.96 for an alleged shortfall linked to periods when her working hours were reduced. She said she had not been told that reducing her hours would affect her share allocation. The employer said the scheme rules allocated shares in proportion to hours worked and applied equally to staff. The adjudication officer found the scheme terms clear and fairly applied. The analyst had received information explaining the pro-rata allocation and had seen other employment terms reduced in line with her working hours. The recommendation was to accept the existing system.
