The WRC declined jurisdiction over an employee’s discrimination and victimisation complaint against a supermarket in a decision dated 12 September 2017. The employee had alleged discrimination on family-status grounds but accepted at the hearing that the complaint had been filed under the wrong legislation; the merits were not decided.
The WRC found that the complaint concerned the employee’s treatment at work, not treatment as a user of the supermarket’s goods or services. It declined jurisdiction because the complaint was misconceived under the Equal Status Act.
