The WRC awarded a shop assistant €3,835 after finding that the sale of her former employer’s painting and decorating shop did not transfer her employment to the new owners’ furniture and interior design business. The decision was dated 25 September 2017. Her former employer argued that the transfer of undertakings rules applied because she briefly worked for the purchaser, so no redundancy payment was due. The WRC found the businesses’ activities were fundamentally different and awarded compensation based on her gross weekly pay and service.
