WRC finds it lacked jurisdiction over manager’s dismissal and notice complaints

By Aoife Loughran

Workplace Relations Commission ·

The Workplace Relations Commission found it lacked jurisdiction over a manager’s unfair-dismissal, notice and annual-leave complaints against a pizza business after finding the business had transferred to a new owner. The decision was dated 25 October 2017. The merits of those complaints were not decided. The manager said his job ended on 5 December 2016 when the business changed hands. The former owner said he had sold the business that day and was not liable. The WRC found the transfer occurred while the employment relationship remained in place, but that the former owner was not the employer for those claims. The Payment of Wages complaint was not well founded because the manager had set aside €83 from the takings as his day’s pay.
