WRC awards chef €7,500 after unfair dismissal during maternity leave

Workplace Relations Commission ·

A WRC adjudication officer awarded a chef €7,500 for unfair dismissal and upheld three working-time complaints, awarding additional sums for Sunday work, public holidays and annual leave. The decision, dated 25 January 2018, followed the catering employer’s non-attendance at the hearing.

The claimant said she was on maternity leave when the business changed hands and that she received no communication about the transfer despite trying to contact her employers. The officer found that the business changed names under the same director and owner, and that the employers failed to contact her or issue a P45. The officer found the dismissal unfair and awarded €7,500 in compensation.

The officer also found well founded the Sunday-work complaint, awarding €500; the public-holiday complaint, awarding €672 in holiday pay and €300 for breach; and the annual-leave complaint, awarding €1,534.58 in holiday pay and €600 for breach.
