The Workplace Relations Commission awarded a worker €15,000 after finding that an entertainment company was responsible for harassment and sexual harassment. The decision was dated 16 November 2017.
The worker said colleagues viewed and discussed compromising photographs of him and subjected him to derogatory remarks and gestures. He said management failed to address his complaints. The company said it investigated his grievance, found discussions about the photographs had occurred and took steps to stop them.
Adjudication officer Jim Dolan found that the treatment violated the worker’s dignity and created a hostile and humiliating environment. He awarded €7,500 for harassment and €7,500 for sexual harassment.
The worker’s constructive dismissal complaint failed because the officer did not believe he had no alternative but to resign. His gender discrimination complaint failed because he did not identify a comparator or explain how he was treated differently. His victimisation complaint also failed because he did not give full details of the alleged victimisation.
