WRC rejects forklift driver’s unfair dismissal and notice complaints

By Tadhg O'Sullivan

Workplace Relations Commission ·

The Workplace Relations Commission rejected a forklift driver’s unfair dismissal and minimum notice complaints after finding that threatening and abusive behaviour during a workplace incident justified dismissal. The decision was dated 20 November 2017. The driver said he had not been properly notified of an earlier meeting about damage to a customer unit and failing to wear protective clothing. The officer accepted that he had not been properly notified, but found that a later serious incident was a direct breach of his employment terms. The minimum notice complaint also failed because he was dismissed for gross misconduct.
