A chef’s redundancy and two working-time complaints against a restaurant were not well founded, the WRC found in a decision dated 16 January 2018. He withdrew his unfair dismissal complaint at the hearing. The chef argued that disciplinary proceedings were used to avoid paying statutory redundancy. The adjudication officer found the disciplinary process followed fair procedures and found no evidence it was used to evade redundancy liability. The chef had not served the notice required to claim redundancy while on lay-off. His working-time complaints also failed: his average hours were below the statutory limit, and he confirmed he received breaks.
