WRC orders car sales business to pay worker €10,000 in withheld commission

Workplace Relations Commission ·

The Workplace Relations Commission ordered a car sales business to pay a worker €10,000 after finding it had illegally withheld commission. Adjudication officer Emer O’Shea dated the decision 10 May 2018.

The worker said commission was owed on vehicle sales and related transactions between September 2016 and March 2017. The business argued it had not paid because he failed to complete paperwork and reconcile two vehicle sales. The WRC found commission was an implied term of his contract and he had not agreed to its non-payment.

The respondent did not attend the second hearing after advising the WRC that the business had ceased trading.
