WRC dismisses social care worker’s unfair dismissal complaint

By Niamh Kearney

Workplace Relations Commission ·

The WRC dismissed a social care worker’s unfair dismissal complaint against a health care provider, finding that his dismissal after an overnight incident was fair. Adjudication Officer Pat Brady dated the decision 4 April 2018. The provider said the worker had been asleep while on night duty and had failed to report a resident’s departure and return. The worker denied sleeping and challenged the investigation and disciplinary process. The WRC found the investigation and disciplinary process fair, and said the worker’s account lacked credibility. It found that dismissal was within the reasonable range of sanctions for his conduct and the nature of the provider’s work.
