The Workplace Relations Commission found a research assistant’s claim for reinstatement was not well founded. Adjudication Officer John Tierney dated the decision 20 March 2018. The third-level institution said the Anti-Bullying Centre’s work had moved to another university and that no alternative post was available. The worker wanted to remain with the institution and disputed that his contract depended on external funding. The officer found a genuine transfer of undertakings had taken place, with the option to transfer on existing terms and continue the work. The worker declined the transfer, and the institution had no alternative position to offer.
