WRC awards Graphic Designer €30,000 after finding dismissal unfair

Workplace Relations Commission ·

The Workplace Relations Commission found that a Graphic Designer was unfairly dismissed and awarded him €30,000 in compensation. Adjudication Officer Joe Donnelly also awarded €3,536 for minimum notice and €3,000 under the Terms of Employment (Information) Act, 1994. The decision was dated 15 January 2018.

The Print Company dismissed the designer after he took its main computer home twice. He said the dismissal came without notice or fair procedures. The company said he had been told not to remove its property and was dismissed after a second incident.

The officer found the designer was an employee from 1 March 2007, noting that the company controlled how and where he worked, he supplied labour only and he worked for one business. The company had no dismissal procedures or appeal process, and the officer found the dismissal unfair. He also found that the designer contributed to the dismissal by taking the computer without permission. The compensation took that contribution and his delay in looking for work into account.
