The WRC awarded a hotel waitress €511 after finding her employer had not followed the consultation process for recovering an overpayment. The award was offset against the €411 she still owed the employer. Adjudication Officer Penelope McGrath dated the decision 15 November 2017. The waitress accepted that she had received two mistaken payments while on unpaid leave, but said the employer imposed repayments without agreeing a manageable process. The employer argued that consultation did not require agreement. The WRC found an overpayment for 80 hours she had not worked and said she should have had the process set out in the company handbook.
