The Workplace Relations Commission awarded a customer agent €9,000 after finding his dismissal procedurally unfair. It also awarded him €732 for statutory notice. The decision was dated 22 March 2018. The outsourced contact centre company said it dismissed him for gross misconduct after a client complained he had mis-sold products. The agent said he followed the sales approach taught and encouraged by team leaders and had received positive feedback. The WRC found substantial grounds existed for dismissal but said the company had not adequately examined his account that team leaders had trained and encouraged his sales approach. It found the dismissal procedurally unfair. The €9,000 award took account of his failure to fully mitigate his loss. His separate minimum-notice complaint succeeded because the company did not show he was ineligible for two weeks’ statutory notice.
