The WRC recommended that a retail company reduce a worker's written warning and restore him to its sick pay scheme after finding the combined sanctions disproportionate. The recommendation was dated 14 November 2017. The worker said most of his absences were related to workplace injuries. The company said it had followed its disciplinary and attendance policies in issuing a warning and removing him from the sick pay scheme for 12 months. The adjudication officer found that some absences counted in the later warning had already been addressed through counselling and a verbal warning. The officer recommended reducing the sanction to a written warning and restoring the worker to the sick pay scheme from 17 October 2016, subject to the company recovering sick pay directly attributable to his workplace injury if his personal injury claim succeeded. The company and union were also recommended to agree a policy for handling potential recoupments.
