Workplace Relations Commission ·

The Workplace Relations Commission awarded a cleaner €8,500 after finding that his employer’s conduct caused him to resign. Adjudication officer Catherine Byrne dated the decision 17 January 2018. The cleaner said he had spent years combining cleaning with catering duties and working long hours, after being encouraged to hope for a better job with the client. The facilities company accepted he had worked beyond his contracted hours and taken on extra duties, but argued that it had addressed his concerns through its grievance process. The officer found that the company had allowed excessive hours and changed his role without agreement. She also criticised its handling of his grievance and found that its conduct was serious and significant, making his decision to resign reasonable. The award was based on an estimate of three months’ earnings before his roster changed. The officer noted that he had provided no evidence of seeking alternative work after resigning.
